Bilyonaryo Andrew Tan has announced his intention to file a lawsuit against construction firm Datem for its alleged failure to fulfill contractual commitments to Megaworld, resulting in additional costs due to project delays.
In an official statement, Megaworld accused Datem of consistently missing promised completion dates for various construction projects, including Eastwood Global Plaza, Uptown Parksuites 1 and 2, among others.
Megaworld said that it was compelled to engage alternative contractors to take over the projects due to what they described as Datem’s gross negligence and blatant disregard for project completion timelines.
“After the lockdown was lifted, DATEM could not catch up with the completion of works for the projects contracted to them. Despite many meetings with their president, Mr. Levy Espiritu, DATEM continued to fail in fulfilling their obligations and worked slower compared to other similar-sized or even smaller contractors,”
Megaworld said.
“Despite their chronic failure to deliver the projects, DATEM demanded a huge amount of claims and adjustments, which Megaworld finds unreasonable considering their bad, substandard, and extremely poor performance as a contractor,” the property development firm added.
Kevin L. Tan, COO of Megaworld’s parent firm Alliance Global Group, Inc. (AGI), said “Datem committed gross negligence in failing to deliver what they have committed. We will sue them for this.”
“To set the record straight, Megaworld has not evaded any substantial claim for payments from Datem, even though they failed to deliver on their commitments. In fact, Megaworld incurred additional costs because of their delays,” Tan emphasized.
