An illegal dismissal case filed against Semirara Mining and Power Corp. and two of its officials has been dismissed by the National Labor Relations Commission.
In a regulatory filing, SMPC said it received a copy of the decision on case dated January 31, 2023, the dispositive portion of which states: “Wherefore, premises considered, judgment is hereby rendered: dismissing the complaint for illegal dismissal and money claims for lack of factual and legal basis.”
The complaint was filed last year against SMPC, its president and COO Cristina Gotianun, and human resources head Almar Valdemar.
SMPC earlier filed the necessary pleadings before the labor arbiter, saying that the termination from employment of the complainant is based on just cause.
“The termination from employment is based on just cause, after being involved in an accident resulting in damages to the company equipment due to his gross negligence,” SMPC said.
