Bilyonaryo Ramon Ang’s South Premiere Power Corp. (SPPC) was granted a writ of injunction by the 13th Division of the Court of Appeals, effectively suspending the implementation of its power supply agreement (PSA) with Manila Electric Co.
The 13th Division of the Court of Appeals said the injunction suspends the PSA but doesn’t terminate it.
“This is to allow the parties to negotiate the terms of the PSA,” the CA said in a ruling promulgated on January 25.
In granting SPPC’s request, the CA said “all the requisites for the grant of a valid WPI were present.”
The Appellate Court sided with SPPC, saying the company will suffer irreparable injury with the continued implementation of the ERC order.
SPPC said it could only operate in the next 10 months if the PSA remains in effect.
