Del Rosario family on Hacienda Balai refund order: Phinma Properties to exhaust all legal remedies available

Phinma Properties of the del Rosario family said the ruling directing it to refund over half a million pesos to a buyer of its Hacienda Balai condominium in Quezon City “has not yet reached its finality.”

Phinma Properties head of Corporate Communications Mia J. Reyes said while they respect the power of the courts to decide on such matters, the company would “exhaust the legal remedies available.”

“As such, this matter has not reached its finality and may be decided otherwise on appeal,” Reyes said.

Phinma lost its case at the Housing and Land Use Regulatory Board which ordered it to refund the equity and amortizations the buyer paid plus damages and fees.

Phinma brought the case to the Court of Appeals and its former 15th division ruled in favor of the buyer.

The company sought a reconsideration of the decision but the appeal was dismissed on June 23, 2022.
